Terms of Use (English Translation)

Article 1 – Purpose

These Terms of Use (hereinafter “Terms” or “CGU”) define the terms and conditions for accessing and using the BeMOGA platform, accessible at www.bemoga.com.

The Platform offers various services, including:

  • a service to connect riders with riding instructors,
  • a subscription and management service for competition registrations,
  • and any other service that may be offered in the future.

These Terms apply to all services offered on the Platform.

Some features may involve products or services governed by separate Terms and Conditions of Sale (CGV).

Article 2 – Publisher Identification

The Platform is published and operated by the BeMOGA association, a non-profit organization governed by the French Law of July 1, 1901.

Article 3 – Definitions

  • User: anyone using the Platform, whether rider, instructor, organizer, or visitor.
  • Rider: any individual using the Platform to register for competitions or access services.
  • Organizer: any natural or legal person (association, company, club, etc.) using the Platform to manage competitions.
  • Instructor: a professional horse riding instructor using the Platform in connection with the matching service.
  • Platform: the whole set of digital services offered by BeMOGA.

Article 4 – Acceptance of the Terms

Accessing or using the Platform implies full and unconditional acceptance of these Terms.

This acceptance is confirmed by creating a user account or by using the services offered.

Article 5 – Access and Account Creation

5.1 Account Creation

Access to the services of the Platform requires creating a user account.

To create an account, at minimum, the user must provide:

  • last name,
  • first name,
  • a valid email address.

Users agree to provide accurate and up-to-date information.

5.2 User Profiles

The Platform is accessible to:

  • riders,
  • riding instructors,
  • organizers, whether individuals or legal entities.

BeMOGA reserves the right to refuse, suspend, or delete access to the Platform if these Terms are violated.

Article 6 – Description of Services

6.1 Instructor / Rider Matching Service

BeMOGA offers a matching service that enables riders to contact riding instructors.

BeMOGA acts solely as a technical intermediary and does not participate in the contractual relationship or the execution of services between the rider and the instructor.

6.2 Competition Registration Management

6.2.1 Nature of the Service

BeMOGA provides organizers with software to manage competition registrations, including:

  • rider registrations,
  • management of entries,
  • payment handling,
  • reservation of additional services (stables, paddocks, optional services).

BeMOGA acts solely as a technical provider and intermediary and is not the organizer of competitions.

6.2.2 Organizer’s Role

The organizer is entirely responsible for:

  • the organization of the competition,
  • the sporting regulations,
  • the conditions of participation,
  • qualifications and entries,
  • proper conduct of the event.

BeMOGA does not control the content, operation, or compliance of competitions organized via the Platform.

6.2.3 Entrant

As part of the organisation of competitions, the first name, last name and horse’s name of entered riders may be published on the BeMOGA website for sporting information purposes.

The persons concerned have the right to object to and to request rectification of their personal data in accordance with the GDPR.

Article 7 – Payments and Payment Service Providers

Competition fees and ancillary services are collected by BeMOGA on behalf of the organizers.

BeMOGA uses payment service providers of its choice, including solutions such as Stripe, Monetico, bank transfer, or equivalent services.

Collected funds are passed on to the organizer, minus applicable commissions, as defined between BeMOGA and the organizer.

In the event of total cancellation of a competition, any refunds to riders are made only after explicit approval by the organizer.

Article 8 – Ancillary Reservations

Reservations of boxes, paddocks, or other services offered through the Platform are services provided exclusively by the organizer.

BeMOGA acts solely as a technical intermediary and does not participate in the execution of these services.

Any dispute regarding these services must be resolved directly between the rider and the organizer.

Article 9 – Liability

BeMOGA provides a technical tool for management and matching but does not organize competitions or execute services offered by organizers or instructors.

Therefore, BeMOGA cannot be held responsible for, among other things:

  • the conduct, cancellation, or modification of a competition,
  • decisions made by an organizer or instructor,
  • disputes between riders, organizers, and instructors,
  • physical, material, or immaterial damage occurring during a competition or any service.

BeMOGA does not provide any insurance for riders, horses, or organizers.

Each organizer is responsible for having the required insurance in compliance with applicable regulations.

Article 10 – Personal Data

Personal data collected through the use of the Platform is processed in accordance with applicable data protection regulations and BeMOGA’s Privacy Policy.

In connection with competition registrations, certain personal data of riders (such as identity, contact information, and registration details) are transmitted to the relevant organizers, who are responsible for processing them as part of the event.

Article 11 – Suspension and Termination

BeMOGA reserves the right to:

  • temporarily suspend a user account,
  • terminate an account,
  • temporarily block funds,

particularly in cases of non-compliance with these Terms, fraudulent use of the Platform, or a proven dispute.

Article 12 – Intellectual Property

All elements of the Platform (software, trademarks, content, graphics, databases, etc.) are protected by intellectual property rights.

Any unauthorized reproduction or use is strictly prohibited.

Article 13 – Modifications to the Terms

BeMOGA may modify these Terms at any time.

Users will be informed of any substantial changes.

Article 14 – Governing Law and Jurisdiction

These Terms are governed by French law.

Any dispute regarding their interpretation or execution falls under the jurisdiction of the competent French courts.
