1. Data Controller

BeMOGA, a non-profit association governed by the French Law of 1 July 1901, whose registered office is located at 347 rue de Crèvecoeur, 60600 Agnetz, France (SIRET: 820 172 575 00020), is the data controller for personal data collected in connection with the use of the bemoga.com website and its services.

2. Purposes of Processing

BeMOGA processes your personal data in particular for the following purposes:

  • creating and managing your BeMOGA account;
  • managing requests for FFE licences, RCPE insurance, horse registrations and other procedures carried out with the French Equestrian Federation (Fédération Française d’Équitation – FFE);
  • managing entries to equestrian competitions;
  • managing registrations, entries and bookings relating to competitions, training courses and events managed through BeMOGA;
  • providing and operating the riding instructor search engine and related services;
  • processing payments, refunds and remittances relating to the services offered;
  • sending information necessary for the processing and follow-up of services;
  • responding to contact and support requests;
  • complying with our administrative, accounting and legal obligations;
  • improving the website and analysing its use through anonymised statistics.

3. Legal Basis

Depending on the nature of the processing, personal data is processed on the basis of:

  • the performance of a contract or steps taken at your request prior to entering into a contract (Article 6(1)(b) GDPR);
  • compliance with legal obligations to which BeMOGA is subject (Article 6(1)(c) GDPR);
  • BeMOGA’s legitimate interests in providing, securing and improving its services (Article 6(1)(f) GDPR);
  • your consent where consent is required (Article 6(1)(a) GDPR).

4. Personal Data Collected

Depending on the services used, BeMOGA may notably collect:

  • Identification data: surname, first name, date of birth and, where necessary, licence number or other federation identifiers;
  • Contact details: postal address, email address and telephone number;
  • Service-related data: licences, RCPE insurance, competition entries, registrations for competitions or training courses, bookings, requests and transaction history;
  • Data relating to riding instructors: professional information and information required for their listing and presentation in the BeMOGA search engine;
  • Technical and browsing data: including pages viewed and anonymised IP address for audience measurement purposes;
  • Transaction information: amount, status and references required to track payments and refunds.

Banking and Payment Data

Payments are processed through secure payment service providers.

BeMOGA neither collects nor stores payment card details or other banking data used to make a payment.

The banking information required to complete a transaction is processed directly by the relevant payment service provider in accordance with its own security and privacy rules.

5. Cookies and Audience Measurement

BeMOGA does not integrate any tool that places third-party cookies for advertising targeting, marketing profiling or advertising tracking purposes.

Cookies placed by BeMOGA are strictly necessary for the operation and use of the website and its services.

BeMOGA also uses a self-hosted version of Matomo to measure website traffic on an anonymised basis.

Matomo is configured in accordance with the recommendations of the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés – CNIL), allowing it, where the required conditions are met, to be used without obtaining prior consent.

This configuration notably includes:

  • hosting the data on BeMOGA’s own servers in France;
  • anonymisation of IP addresses;
  • use of the data exclusively for audience measurement and website improvement purposes;
  • no cross-referencing with data obtained from third parties;
  • no use for advertising or marketing targeting purposes.

BeMOGA does not provide audience measurement data to advertising networks.

6. Data Retention

Personal data relating to the use of BeMOGA’s services and services provided through BeMOGA is retained for a period of 10 years.

This retention period notably enables BeMOGA to ensure the traceability of transactions and comply with its legal, accounting and administrative obligations.

Anonymised data that can no longer be used to identify an individual is no longer considered personal data and may be retained for statistical purposes.

7. Recipients of Personal Data

Personal data is accessible to authorised persons within BeMOGA only to the extent necessary for the performance of their duties.

Depending on the service used, certain data may also be disclosed or made accessible:

  • to the French Equestrian Federation (FFE) and its service providers where necessary for the management of licences, RCPE insurance, competition entries or other federation-related procedures;
  • to organisers of competitions, training courses or events whose registrations, entries or bookings are managed through BeMOGA, as well as their service providers involved in organising or delivering the event, limited to the information necessary for such management;
  • to BeMOGA’s technical service providers, notably for hosting, email delivery, payment processing or the technical operation of the Platform, limited to the data necessary for the provision of their services;
  • to public authorities, administrative bodies or other authorised organisations where required by law.

Personal data is neither sold nor rented to third parties for commercial or advertising purposes.

Where a transfer of personal data outside the European Union is necessary, BeMOGA ensures that the transfer is carried out in accordance with the requirements of the GDPR and subject to appropriate safeguards.

8. Security

BeMOGA implements technical and organisational measures designed to protect personal data against loss, unauthorised access, disclosure, alteration or destruction.

These measures notably include the use of secure connections (HTTPS), access controls, regular backups and measures to secure the technical infrastructure.

9. Your Rights

In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés), you have, subject to the conditions provided by applicable law, the following rights:

  • the right to access your personal data;
  • the right to rectification;
  • the right to erasure;
  • the right to restriction of processing;
  • the right to object;
  • the right to data portability where applicable;
  • the right to withdraw your consent at any time where processing is based on consent.

You also have the right to lodge a complaint with the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés – CNIL).

BeMOGA may amend this Privacy Policy, in particular to reflect changes to its services, practices or applicable law.
