Terms and Conditions of Sale

It is a non-binding translation of the original French version.
In the event of any discrepancy, interpretation issue, or dispute, the French version shall prevail and be legally binding.

1. Purpose

These Terms and Conditions of Sale (hereinafter the “Terms”) govern the contractual relationship between BeMOGA, a non-profit association governed by French law (Law of 1901), and any natural or legal person (hereinafter the “Customer”) making a purchase or subscribing to a service via the website www.bemoga.com.

These Terms apply in particular to:

  • the sale of products and services offered by BeMOGA;
  • the provision of administrative services related to FFE licences;
  • competition entries facilitated via the platform;
  • any related optional services or administrative fees.

Use of the website is also governed by the Terms of Use (CGU).

2. Acceptance of the Terms

Any order placed on the website implies full and unconditional acceptance of these Terms by the Customer.

3. Modification of the Terms

BeMOGA reserves the right to modify these Terms at any time.

The applicable Terms are those in force on the date the order is placed.

4. Right of Withdrawal

In accordance with French consumer law, the right of withdrawal does not apply to:

  • services fully performed before the end of the withdrawal period;
  • personalized services;
  • services linked to a specific date or sporting event, including competition entries and licences.

5. Administrative Fees and Refunds

Administrative or processing fees may apply to certain services.

These fees are clearly indicated during the ordering process.

Unless otherwise required by law, these fees are non-refundable, except in cases where cancellation is directly attributable to BeMOGA.

Any eligible refund will be made within a maximum of fourteen (14) days using the same payment method as the original transaction, unless otherwise agreed with the Customer.

6. Prices and Payment

All prices are expressed in euros (€), inclusive of all applicable taxes.

Payment is due immediately upon placing the order.

Accepted payment methods are those indicated on the website at the time of purchase.

7. Force Majeure

BeMOGA shall not be held liable for failure or delay in performance due to an event of force majeure as defined by French law.

Routine technical maintenance, hosting incidents, or temporary service interruptions do not constitute force majeure.

8. Liability

BeMOGA acts as an intermediary for certain services, including those provided by third-party organizations such as the French Equestrian Federation (FFE).

BeMOGA cannot be held responsible for decisions, modifications, or cancellations made by such third parties.

In all cases, BeMOGA’s liability is strictly limited to the amount paid by the Customer for the service concerned.

9. Personal Data

Personal data collected via the website are processed in compliance with applicable French law and the General Data Protection Regulation (GDPR).

The data controller is BeMOGA’s legal representative.

10. Evidence

Electronic records stored in BeMOGA’s information systems shall constitute valid proof of transactions, communications, and payments.

11. Governing Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, the Customer is invited to contact BeMOGA in order to seek an amicable solution.

Failing such resolution, any dispute shall fall under the exclusive jurisdiction of the competent French courts.

Consumers may also use the European Online Dispute Resolution platform.
